У процесі моніторингу екологічних відкритих даних ми проаналізували загальну доступність та регулярність оновлення 209 набір від 74 розпорядник. Дослідження охоплює період з початку 2022 року (до початку повномасштабної війни) до жовтня 2024 року включно, що дозволяє оцінити динаміку публікації даних і рівень дотримання вимог до їх відкритості.

Хто з розпорядників найбільш відкритий?

Через те, що розпорядників екологічних даних в Постанові №835 дуже багато, а кількість наборів у них суттєво відрізняється, ми виділили найбільших розпорядників за кількістю наборів, і порівняли їхні показники між собою.

Також ми згрупували усіх розпорядників за типом органу влади – міністерства, відомства, ОДА (ОВА) та міські ради регіональних центрів.

І в кожній з цих груп порахували відносну кількість відкритих екологічних наборів, щоб можна було порівняти їх між собою.

Відкритість міських рад та регіональних адміністрацій

Постанова №835 містить в собі два екологічних набори відкритих даних, які повинні публікувати місцеві держадміністрації та органи місцевого самоврядування.

“Перелік дозволів на викиди забруднюючих речовин в атмосферне повітря стаціонарними джерелами об’єктів 2 і 3 груп із зазначенням номера та строку дії (для облдержадміністрацій)”
“Дані про зелені насадження, що підлягають видаленню, відповідно до виданих актів обстеження зелених насаджень” - для міських рад регіональних центрів

Для кожного з цих наборів ми побудували картографічне відображення, щоб наочно побачити де й хто більш відкритий або закритий.

Прогрес у відкритості: більше екологічних даних стає доступним

Системна співпраця з Офісом Омбудсмана, Міністерством цифрової трансформації та розпорядниками даних дає позитивні результати – кількість екологічних наборів даних у відкритому доступі поступово зростає. Це підтверджує статистика нижче, яка наочно демонструє прогрес у забезпеченні прозорості та доступності екологічної інформації для громадськості.

Зараз ми спостерігаємо поступове відновлення доступу до екологічної інформації у формі відкритих даних, однак наразі виконання вимог Постанови №835 розпорядниками все ще є далеким від належного. Ми й надалі будемо проводити регулярний моніторинг доступу до екологічних відкритих даних щопівроку, щоб відстежувати зміни та тенденції.

Водночас наша команда продовжуватиме співпрацю з розпорядниками екологічної інформації, сприяючи забезпеченню відкритого доступу до важливих даних для громадськості та активістів.

Водночас існує значна кількість наборів даних, доступ до яких обмежено або закрито. А значить, ми всі маємо докласти подальших зусиль для відновлення та забезпечення інформаційних прав громадян та для повного виконання Постанови №835 всіма державними установами.

Аналіз доступу до екологічної інформації

Екологічна інформація має особливий статус – вона ніким не може бути засекречена (ст. 50 Конституції України). Адже інформація про стан довкілля, забруднення, рівень викидів або стан природних ресурсів допомагає визначати проблеми й планувати заходи для їх вирішення. У контексті глобальних викликів, міжнародні угоди вимагають від держав забезпечувати доступ до екологічної інформації.

Орхуська конвенція, ратифікована Україною, захищає право громадян на доступ до екологічної інформації, оскільки без такого доступу неможливо реалізувати право на участь у прийнятті рішень з питань довкілля, а також право на доступ до правосуддя у питаннях, що стосуються довкілля.
